Terms & Conditions

By installing or using any SB Hero application, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not install or use our apps. These terms apply to all users of SB Hero products and services.

Use of the services is also governed by our Privacy Policy, incorporated herein by reference.

SB Hero Technologies Inc. (“SB Hero”, “we”, “us”, or “our”) develops and operates Shopify applications for small business inventory management and related tools, including Epic Inventory. Our apps are distributed through the Shopify App Store and are intended for use by Shopify merchants.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

Our software is provided “as-is” and “as available” without warranties of any kind, either express or implied. SB Hero makes no guarantee of:

• Accuracy or completeness of inventory data or calculations
• Uninterrupted uptime or availability of the service
• Fitness for a particular purpose or merchantability
• Compatibility with all Shopify store configurations

Use of our apps is at your own risk. We strongly recommend maintaining independent records of your inventory data.

To the maximum extent permitted by applicable law, SB Hero Technologies Inc. shall not be liable for any:

• Loss or corruption of data
• Inventory errors or discrepancies
• Lost sales, revenue, or profits
• Indirect, incidental, special, or consequential damages of any kind

SB Hero does not guarantee preservation of any data and users are solely responsible for maintaining independent backups.

In any case, SB Hero’s total liability to you for any claim arising out of or relating to these terms or our services shall not exceed the greater of $100 USD or total fees paid to SB Hero during the previous 12 months preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless SB Hero Technologies Inc., its directors, officers, employees, and affiliates from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the services, your violation of these Terms, or your violation of any law or third-party rights.

You are solely responsible for:

• Maintaining your own independent backups of inventory and business data
• Ensuring the accuracy of data you enter into our apps
• Compliance with Shopify’s terms of service and applicable laws
• Keeping your account credentials secure

You agree not to misuse our services or attempt to access them in unauthorised ways.

You may cancel your subscription at any time through your Shopify admin. SB Hero may suspend or terminate your access immediately for misuse, abuse, non-payment, security concerns, or violations of these Terms. Upon termination, your right to use the services ceases immediately.

SB Hero shall not be liable for delays or failures resulting from causes beyond its reasonable control, including internet outages, platform outages, acts of God, governmental actions, cyberattacks, labor disputes, or failures of third-party service providers.

SB Hero subscriptions are billed on a monthly basis through the Shopify billing system. All billing is processed in USD through the Shopify billing system. SB Hero does not control currency conversion and is not responsible for any exchange rate differences applied by your bank or payment provider. SB Hero does not offer refunds for partial billing periods except where required by law.

We reserve the right to change our pricing with reasonable advance notice. Continued use of the service after a price change constitutes acceptance of the new pricing.

We reserve the right to update or modify these Terms & Conditions at any time. When we make material changes, we will update the “Last updated” date at the top of this page and, where appropriate, notify active users by email. Your continued use of our apps following any changes constitutes your acceptance of the revised terms.

These Terms & Conditions are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
